Website Privacy Notice
This notice explains how Muir Myles Laverty, trading as MML Law (“MML”, “we”, “us”), uses personal information collected through this website, mmllaw.co.uk. If you become a client, our Privacy Notice for clients also applies and explains how we handle information about your legal matter.
Who we are
Muir Myles Laverty is a partnership and the data controller for personal information collected through this website. Our address is Meadowplace Building, Bell Street, Dundee DD1 1EJ.
Our Data Protection Officer is Alan Fraser. You can contact him by email at alan@mmllaw.co.uk, by phone on 01382 206000, or by post at the address above.
What we collect and why
We only collect what you choose to give us, and what is needed to run the website securely.
- Enquiries through our contact form: your name, email address, phone number (if given), how you would like us to contact you, what your enquiry is about, and your message. We use this to reply to you and, if you ask us to act, to take the first steps towards doing so.
- Property viewings and valuations: your contact details, the property you are interested in or the address of the property you want valued, and any details you add. We use this to arrange the viewing or valuation.
- Online payments: your name, email address, company name (if given), the amount and your invoice reference. Card details are entered on our payment provider’s secure page and are never seen or stored by us.
- Technical information: our hosting and content delivery providers process your IP address and the pages you request, so that the website can be delivered and protected against misuse.
- Spam protection: our forms use Google reCAPTCHA, which checks that a form is being filled in by a person and not an automated program. To do this Google receives your IP address and information about how you interact with the page, and sets a cookie.
Please do not send us confidential or sensitive details of your matter through the website. We will ask for what we need once we have spoken to you.
Our lawful bases
- Replying to enquiries and arranging viewings and valuations: our legitimate interests in responding to people who contact us, and taking steps at your request before entering into a contract with you.
- Online payments: performing our contract with you, and our legal obligations to keep accounting records.
- Technical information and spam protection: our legitimate interests in running a secure, working website and protecting our forms from abuse.
We do not use your information for marketing unless you have separately agreed to it, and we do not sell it.
Who we share it with
We use a small number of service providers who process information for us, under contract and only on our instructions:
- netcup GmbH (Austria): hosts the website and the information you submit.
- BunnyWay d.o.o. (Slovenia), trading as Bunny.net: delivers the website’s pages quickly and protects it from attack.
- Postmark, provided by ActiveCampaign, LLC (USA): delivers the emails that pass your enquiry to our team.
- Lloyds Bank Cardnet (UK): processes online card payments on its own secure page.
- Google LLC (USA): provides reCAPTCHA spam protection on our forms. Google’s use of this information is covered by its privacy policy.
If you instruct us, we may share information as described in our Privacy Notice for clients. We may also disclose information where the law requires it.
Transfers outside the UK
Austria and Slovenia are in the European Economic Area, which UK law recognises as providing adequate protection. Postmark and Google are based in the USA; where information is passed to them, the transfer is protected by the safeguards UK data protection law requires, such as the UK Extension to the EU–US Data Privacy Framework or the UK International Data Transfer Addendum.
How long we keep it
- Enquiries, viewing requests and valuation requests that do not lead to us acting for you are deleted after 12 months.
- If you instruct us, your information becomes part of your client file and is kept as set out in our Privacy Notice for clients.
- Payment records are kept for six years after the end of the financial year they relate to, to meet our accounting obligations.
Cookies
This website does not use advertising, tracking or analytics cookies. The only cookie is set by Google reCAPTCHA to protect our forms from spam. See our Cookies page for details.
Your rights
Under the UK General Data Protection Regulation and the Data Protection Act 2018, you have the right to:
- ask for a copy of the personal information we hold about you;
- ask us to correct information that is wrong or incomplete;
- ask us to delete your information;
- ask us to restrict how we use it, or object to our using it on the basis of legitimate interests;
- ask for information you gave us to be transferred to another organisation, where that applies.
Some of these rights are limited, for example where we must keep records by law. To use any of them, contact our Data Protection Officer. We will respond within one month.
Complaints
If you are unhappy with how we have handled your information, please contact our Data Protection Officer first. You also have the right to complain to the Information Commissioner’s Office: ico.org.uk/make-a-complaint, telephone 0303 123 1113.
