The rights of all children to grow up, wherever possible, in a safe, stable family environment are enshrined in the constitution. There are times, however, when a child is unable to live with his or her family, and therefore he or she may not have direct and regular access to parents, grandparents and siblings. Scottish law, allied to the UN Convention of the Rights of the Child (UNCRC), is clear about the rights of all family members of the children in question, but not at the expense of the child’s rights.

Encouraging, supporting and ultimately protecting the existing bonds between siblings, half-siblings and step-siblings is vital for the development of the children, and for helping them to become fully-rounded adults. As is the case with parents and grandparents, however, the rights of brothers and sisters will take second place to the welfare of the child.
