Unlawful deductions from wages

Almost everyone who has a job, irrespective of what type of job, performs their work duties in return for a financial reward. For the vast majority of us, the transaction is something we rarely think about. We carry out our side of the bargain, then get paid at the end of every week or month. What would happen, however, if your employer didn’t pay the full amount or, perhaps, deducted money against your will?

Every employer is entitled to deduct money from an employee’s wages, but only for specific reasons. They include income tax payments and National Insurance contributions, for example. Student loan repayments can be included, too, as can any particular deductions as authorised in writing by the employee. Apart from these conditions, there are very few instances in which such an action would be lawful.

If you’re an employee and you are concerned that your employer may have unlawfully deducted some or all of your wages, or perhaps has underpaid you in the first place, we’d like to hear from you. Our employment law specialists have a reputation for being empathetic with clients and tenacious in our dealings on their behalf. With MML on your side, the chances of a successful outcome could be greatly increased.

The ultimate conclusion in many cases of unlawful wage deductions is a tribunal case, and we have the experience and the know-how to help you find the justice you deserve. In many instances, however, we have found that a strongly-worded letter from a reputable law firm is enough to make the company, whether that means an individual or perhaps an HR department, think again.

One of the exceptions to the overpayment rule is that employers are entitled to recover monies if they have overpaid the individual because of an oversight. Given the efficiency of most payroll systems these days, however, this is a relatively rare occurrence. As always, our knowledgeable team of experts will be happy to answer any questions if you’re unsure about any matter.

In general, the amount of money you are paid in any given week or month tends to be a part of your contract of employment, and any changes to that amount needs to be implemented lawfully. When an employer fails to live up to their side of the bargain, there’s every chance that an unlawful act will have occurred. This is when you need to be speaking to a legal team.
